ECHR FINDS SWITZERLAND GUILTY OF SENDING GAY MIGRANT BACK TO COUNTRY

Serhat TUNAR -TDO- The European Court of Human Rights (ECHR) has convicted Switzerland, which has decided to repatriate a gay Gambian immigrant, on the grounds that Switzerland has violated human rights because it does not take into account the ill-treatment that this immigrant will face when he is sent back to his country.

Ruling that Article three of the European Convention on Human Rights for the Prohibition of ill-treatment and torture had been violated, the ECHR ordered that Switzerland pay the applicant 14,500 euros in financial compensation, including court costs.

The request of the Gambian immigrant, who came to Switzerland in 2008 and sought asylum, was rejected in 2014 on the grounds that he was not sufficiently adapted to the country and that conditions for homosexuals had improved in Gambia.
